1. Who we are and what this policy covers

Solport Sistemas, S.L. "Solport", "we"), with tax ID (CIF) B64039894 and registered address at Carrer 27, 10-16, Sector BZ, Sants-Montjuïc, 08040 Barcelona (Spain), develops management software for the port-logistics and foreign trade sector. This policy explains how we process your personal data as data controller when you visit this website (solport.net), get in touch with us, or request information or a demo of our products.

Regarding the personal data we process on behalf of our clients through SP Suite and our other platforms (for example, data a client manages within its ERP), the client is the data controller and Solport acts as data processor under the corresponding data processing agreement. That processing is governed by that agreement and not by this policy.

Our services are aimed at businesses, not minors; we do not knowingly collect data from minors.

2. What data we process and for what purpose

2.1 When you visit this website

When you browse the site for purely informational purposes, we process the data your browser sends (in particular, IP address, date and time of the request, browser type and operating system) to display the site to you and keep it stable and secure. Legal basis: our legitimate interest in a functional and secure website (Art. 6(1)(f) GDPR). Cookies and other tracking technologies are covered in section 4.

2.2 When you contact us

This site does not include forms that collect personal data: contact is made by writing to us at info@solport.net, calling us at +34 93 567 76 76, or through our LinkedIn profile. When you contact us to request information or a demo, we process your professional contact details and the content of your request in order to assist you and manage the business relationship. Legal basis: taking pre-contractual steps at your request (Art. 6(1)(b) GDPR) and our legitimate interest in managing inquiries and business relationships (Art. 6(1)(f) GDPR).

2.3 Location map (Google Maps)

Our contact page includes an embedded Google Maps map. When it loads, Google Ireland Ltd. may process your IP address and set its own cookies. As this is non-essential third-party content, it should only load with your consent (section 4); in the meantime, you can block third-party cookies from your browser settings.

2.4 Source of the data

We generally receive your data directly from you. We may also obtain professional contact details from publicly available sources (for example, your company website or professional profiles) for business development purposes, on the basis of our legitimate interest (Art. 6(1)(f) GDPR).

3. Our mobile applications (SP Truck and SPAppTransporte)

In addition to the website, Solport publishes mobile applications that provide field service to our clients' users, including SPAppTransporte, the cab application of our SP Truck module. When you use one of these applications as an employee or contractor of a client, it is your organization that decides and controls the processing: it acts as data controller and Solport as data processor (section 1). That processing is governed by the contract between your organization and Solport. For transparency, and to comply with the requirements of the app stores (Google Play and App Store), this section describes what device data and permissions the application accesses and for what purpose. The application does not use this data for advertising purposes nor does it sell it to third parties.

3.1 Location (GPS)

With your permission, the application accesses the device location to reflect the position of the vehicle, the route actually taken versus the planned route, the estimated time of arrival, and the service milestones (pickup, en route, delivery). Location is used only while you have an active service or trip and only for these operational functions. You can grant or revoke this permission at any time from your device settings; if you revoke it, tracking and geolocation features will no longer be available.

3.2 Camera

The application may access the camera so that you can capture proof of delivery (POD), photographs of incidents, and documents attached to a service. Images are only taken when you initiate the action; the application does not access the camera in the background.

3.3 Files and storage

The application accesses device storage to attach and temporarily save the documents, photographs, and signatures associated with a service, and to let you keep working without coverage (offline mode), syncing the information once the network connection is restored. Access is limited to the files you select or that the application itself generates for the service.

3.4 Transmission to the server and connection security

The captured data is sent to the SP Suite server designated by your organization, which is configurable per client. Communication with that server takes place over the network and protocol your organization has configured; we recommend and prioritize the use of encrypted connections (HTTPS/TLS). The availability of encryption in transit also depends on the server configuration, which is your organization's responsibility.

3.5 Your rights and retention within the applications

Since this data is processed on behalf of your organization, to exercise your rights (section 7) you must contact your organization, which is the data controller; Solport, as processor, will provide it with the necessary assistance. The retention periods for data processed through the applications are governed by the contract with your organization and not by the indicative periods in section 6, which refer to the website.

4. Cookies, analytics and tracking

This site uses only the technical cookies strictly necessary for it to function. We do not use our own analytics or marketing cookies. Any non-essential cookie or tracking technology, as well as embedded third-party content (such as the Google Maps map), is only activated with your prior consent, which you can give through our cookie banner and withdraw at any time with future effect. Legal basis: your consent (Art. 6(1)(a) GDPR, together with Art. 22.2 of Spanish Law 34/2002, LSSI-CE).

If we add measurement or marketing tools in the future, we will reflect this in this policy and in a separate cookie policy detailing each cookie, its provider, and its retention period.

5. Data disclosure and international transfers

5.1 Who we share your data with

We share personal data only to the extent necessary for the purposes described:

  • Providers that process data on our behalf and following our instructions (data processors): Microsoft (site hosting on Azure Static Web Apps and email on Microsoft 365), Cloudflare (DNS service) and Google (embedded map on the contact page).
  • Professional advisors (lawyers, auditors) when necessary.
  • Authorities and courts, when there is a legal obligation.
  • A buyer or successor, in the event of a merger, acquisition, or sale of assets, with appropriate confidentiality safeguards.

We do not sell your personal data.

5.2 International transfers

Some of our providers (in particular Microsoft and Google) belong to groups headquartered in the United States. For each transfer we rely on an appropriate safeguard under Chapter V of the GDPR: when the provider is certified under the EU-US Data Privacy Framework, the transfer is covered by the European Commission adequacy decision of 10 July 2023 (Implementing Decision (EU) 2023/1795); when it is not, we apply the Commission Standard Contractual Clauses (Decision (EU) 2021/914) together with a transfer impact assessment. You can check any provider’s certification at www.dataprivacyframework.gov and request a copy of the safeguards by writing to info@solport.net.

6. How long we retain your data

We retain personal data only for as long as necessary for the purposes described or as required by law. As an indicative guide:

  • Server logs: for a short period for security and stability reasons, after which they are deleted or anonymized.
  • Contact details and business inquiries: for as long as your request or business relationship is being handled and, afterward, for the applicable legal limitation periods.
  • Commercial correspondence and documentation: six (6) years (Art. 30 of the Spanish Commercial Code).
  • Tax obligations: four (4) years (Arts. 66 et seq. of the Spanish General Tax Law), or the longer period required by applicable regulations.
  • Data based on your consent: until you withdraw it or object, at which point we delete or anonymize it.

7. Your rights

You can exercise the rights of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), portability (Art. 20), and objection to processing based on our legitimate interest (Art. 21). You can object to commercial communications at any time, without needing to give a reason. Where processing is based on your consent, you can withdraw it at any time with future effect (Art. 7(3)), without affecting the lawfulness of processing carried out before its withdrawal.

To exercise any right, write to us at info@solport.net. We will respond within one month, extendable by a further two months for complex requests (Art. 12(3) GDPR). Exercising your rights is free of charge and we may need to verify your identity before acting. You also have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD), C/ Jorge Juan, 6, 28001 Madrid, Spain (www.aepd.es).

8. Automated decisions and artificial intelligence

We do not make decisions that produce legal effects concerning you, or similarly significantly affect you, based solely on automated processing (Art. 22 GDPR). When we use automated tools or AI assistance, a person oversees and is responsible for the outcome.

9. How we protect your data

We apply appropriate technical and organizational measures to protect personal data against loss, misuse, and unauthorized access, including encryption in transit (HTTPS/TLS), security headers, access controls, and due diligence on the providers we engage.

10. Links to other sites

This site may contain links to third-party websites (for example, LinkedIn or Google Maps). We are not responsible for their content or privacy practices. We recommend reviewing the privacy policy of any site you access through a link before providing it with data.

11. Changes to this policy

We may update this policy to reflect changes in our processing activities or in applicable regulations. We will publish the current version here along with its date. If the changes are substantial, we will take appropriate steps to inform you.
